These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Traveller", "you", or "your") and Jetlagged Private Limited, a company incorporated under the Companies Act, 2013, operating under the trade name Jetlagd ("Jetlagd", "we", "us", or "our"), with its registered office at Q 1003, Phase 3, Centria Hills And Dales Apartment, Mohamadwadi, Pune — 411060, India.
By browsing our website at jetlagd.com, creating a Jetlagd Club account, making a booking, or participating in any Jetlagd trip or experience, you agree to be bound by these Terms in their entirety. If you do not agree, please do not use our services or make a booking.
PLEASE READ THESE TERMS CAREFULLY BEFORE MAKING A BOOKING. IN PARTICULAR, PLEASE NOTE THE LIMITATIONS ON OUR LIABILITY IN SECTION 12, THE CANCELLATION AND REFUND POLICY IN SECTION 6, OUR RIGHT TO MODIFY ITINERARIES IN SECTION 8, AND THE TRAVELLER CONDUCT PROVISIONS IN SECTION 13.
1. DEFINITIONS
In these Terms, the following definitions apply:
— "Booking" means a confirmed reservation for a Trip made by a Lead Traveller on behalf of themselves and, where applicable, one or more Additional Travellers.
— "Lead Traveller" means the individual aged 18 or above who makes the Booking and accepts these Terms on behalf of all persons included in the Booking.
— "Additional Traveller" means any person other than the Lead Traveller included in a Booking.
— "Trip" means a group travel experience organised and operated by Jetlagd, including all included activities, accommodation, and ground transport as specified in the relevant trip itinerary.
— "Trip Cost" means the total amount payable by a Traveller for a Trip, as set out in the Booking confirmation.
— "Itinerary" means the detailed trip programme provided at the time of Booking, which is subject to change in accordance with Section 8 of these Terms.
— "Supplier" means any third-party provider of services used in connection with a Trip, including but not limited to accommodation providers, ground transport operators, local guides, activity providers, and destination management companies.
— "Force Majeure Event" has the meaning given in Section 14.
— "Jetlagd Club" means the membership programme operated by Jetlagd as described at jetlagd.com/club.
— "JetPoints" means the reward points issued under the Jetlagd Club programme in accordance with the JetPoints Terms set out in Section 16.
2. ELIGIBILITY AND BOOKING AUTHORITY
To make a Booking, you must:
— Be at least 18 years of age at the time of making the Booking
— Have the legal capacity to enter into a binding contract under Indian law
— Provide accurate, complete, and truthful information at the time of Booking
By making a Booking, the Lead Traveller warrants that they have the authority to book on behalf of all Additional Travellers named in the Booking, that all Additional Travellers have been made aware of and have agreed to these Terms, and that all information provided in respect of each Traveller is accurate.
The Lead Traveller accepts personal responsibility for ensuring that all Travellers in their Booking comply with these Terms, including the Code of Conduct in Section 13. Where a minor is included in a Booking made by an adult, the Lead Traveller warrants that they have parental or legal guardian authority to include that minor and to provide their personal data.
Jetlagd reserves the right to refuse a Booking from any person at its sole discretion, without being required to provide a reason.
3. BOOKING PROCESS AND CONFIRMATION
A Booking is made when the Lead Traveller completes the booking form on jetlagd.com and pays the required deposit or full Trip Cost.
A Booking is not confirmed until Jetlagd has issued a written booking confirmation by email. Receipt of a deposit payment does not constitute confirmation of a Booking. Jetlagd reserves the right to decline a Booking after receipt of payment, in which case any deposit paid will be refunded in full.
It is the Lead Traveller's responsibility to check the booking confirmation carefully and notify Jetlagd of any errors or discrepancies within 48 hours of receipt. Jetlagd shall not be liable for any loss arising from errors in the Booking that were not notified to us within this period.
Availability of Trips is not guaranteed until a booking confirmation is issued. Jetlagd operates on a first-confirmed, first-served basis. Where a Trip is full at the time of Booking, Jetlagd may offer to place the Traveller on a waitlist, which does not constitute a confirmed Booking.
4. PRICING AND FEES
All Trip prices are displayed on jetlagd.com in Indian Rupees (INR) unless otherwise stated. Prices are correct at the time of display but are subject to change at any time prior to the issuance of a booking confirmation.
The Trip Cost includes only those elements expressly stated as included on the trip page and in the booking confirmation. Unless explicitly stated otherwise, the Trip Cost does not include:
— International or domestic flights to and from the start and end point of the Trip
— Airport transfers, unless specified in the Itinerary
— Lunches and dinners, unless specified in the Itinerary
— Visa fees and related costs
— Travel insurance premiums
— Personal expenses, gratuities, and discretionary spend
— Activities, excursions, or experiences not listed in the Itinerary
— Costs arising from itinerary changes, delays, or disruptions beyond Jetlagd's control
Jetlagd reserves the right to levy a surcharge on confirmed Bookings in the event of significant increases in fuel costs, taxes, government levies, currency fluctuation, or other costs beyond our reasonable control. We will provide at least 30 days' notice of any such surcharge. If the surcharge exceeds 8% of the Trip Cost, the Traveller may cancel the Booking and receive a full refund of monies paid.
5. PAYMENT
Payment terms are as specified on the trip page and in the booking confirmation for each Trip. Generally:
— A non-refundable deposit is required at the time of Booking to secure the Traveller's place. The deposit amount is specified on the trip page and booking confirmation.
— The balance of the Trip Cost is due [X] days before the departure date. Where an instalment plan is offered, the schedule of payments is specified on the trip page.
— Where full payment is not received by the due date, Jetlagd reserves the right to treat the Booking as cancelled and apply the cancellation charges in Section 6.
Payment must be made by the methods specified at checkout. Jetlagd does not store payment card data. All card transactions are processed securely by our payment gateway provider.
All payments are in Indian Rupees unless otherwise stated. Where a Traveller makes payment in a foreign currency, any exchange rate losses or bank charges are the Traveller's responsibility.
6. CANCELLATIONS, CHANGES, AND REFUNDS
Cancellation by the Traveller
If you wish to cancel your Booking, you must notify Jetlagd in writing to contact@jetlagd.com. The date of cancellation is the date on which Jetlagd receives your written notice. The following cancellation charges apply:
— More than 90 days before departure: 100% credit or refund with 10% cancellation charges.
— 61-90 days before departure: 30% cancellation charges.
— 31 - 60 days before departure: 50% cancellation charges
— <30 days before departure: No refund.
Non-Refundable Components: Where your Trip includes event tickets, sporting fixtures, concert or festival passes, airline tickets, or any other third-party booking that is non-refundable at the time of your cancellation, no refund shall be made in respect of those components regardless of when you cancel. Non-refundable components will be clearly identified in your booking confirmation.
Jetlagd strongly recommends that all Travellers purchase comprehensive travel insurance including trip cancellation cover prior to or at the time of Booking.
Transfer of Booking
A Booking may be transferred to another eligible Traveller subject to availability and receipt of a transfer request at least 30 days prior to departure. A transfer fee of ₹8000 applies. The incoming Traveller must meet all eligibility requirements and submit all required personal information before the transfer is confirmed. The Lead Traveller and the incoming Traveller are jointly and severally liable for any outstanding balance and applicable fees.
Date Change by the Traveller
Requests to change departure dates must be made in writing at least 30 days before the original departure date and are subject to availability. A date change fee of ₹8000 applies. If the new departure carries a different price, the difference will be charged or credited accordingly.
Cancellation or Modification by Jetlagd
Jetlagd reserves the right to cancel any Trip at any time prior to departure. In the event of cancellation by Jetlagd (other than due to Force Majeure or the Traveller's own fault):
— Jetlagd will offer the Traveller the option to transfer to an alternative departure at no additional charge, or
— A full refund of all monies paid to Jetlagd will be issued within 15 business days
Jetlagd's liability in the event of cancellation is limited to a refund of the Trip Cost paid to Jetlagd. Jetlagd shall not be liable for any consequential losses, including but not limited to flight costs, accommodation booked independently, visa fees, travel insurance premiums, or loss of earnings.
Where a Trip is cancelled due to a Force Majeure Event, Section 14 applies.
Minimum Numbers
Certain Trips require a minimum number of confirmed Travellers to operate. Where a Trip does not reach its minimum number, Jetlagd reserves the right to cancel the Trip. Notice of cancellation on this basis will be given at least 7 days before the departure date, and Travellers will be offered the options described above.
7. TRAVEL DOCUMENTATION, VISAS, AND HEALTH REQUIREMENTS
It is the sole responsibility of each Traveller to ensure they hold valid travel documentation required for their Trip, including:
— A valid passport with at least six months' validity beyond the return date of the Trip
— All visas, entry permits, and travel authorisations required for the destination(s) visited
— All vaccination certificates, health declarations, or other health documentation required by destination authorities
Jetlagd may provide general guidance on visa and entry requirements for commonly held passports as a courtesy. This guidance is for informational purposes only, is not guaranteed to be accurate or current, and does not constitute legal advice. Jetlagd does not apply for visas on behalf of Travellers and accepts no responsibility for visa refusals, delays, or the consequences thereof.
If a Traveller is unable to travel due to failure to obtain required documentation, no refund will be made and the cancellation charges in Section 6 will apply.
It is the Traveller's responsibility to comply with all entry, health, customs, and immigration requirements of every country visited during the Trip. Jetlagd shall not be liable for any costs, losses, or consequences arising from a Traveller's failure to comply with such requirements.
8. ITINERARY CHANGES AND SUBSTITUTIONS
Jetlagd reserves the right to make changes to any Trip Itinerary at any time, before or during the Trip, without prior notice to Travellers. Such changes may include but are not limited to:
— Changes to the sequence of activities or destinations
— Substitution of accommodation with accommodation of a comparable or higher standard
— Substitution or removal of activities, experiences, or excursions
— Changes to ground transport arrangements
— Changes to meal arrangements
— Changes to departure or return times
Itinerary changes may be made for reasons including, without limitation, operational requirements, safety considerations, weather conditions, supplier unavailability, local conditions, government directives, Force Majeure Events, or any other circumstances at Jetlagd's discretion.
No compensation, refund, or price reduction shall be payable by Jetlagd in respect of changes to the Itinerary, whether made before or during the Trip, unless the change constitutes a Significant Change as defined below.
Significant Changes
A Significant Change is defined as a change to any of the following core elements of the Trip, made by Jetlagd more than 15 days before departure:
— The departure date
— The primary destination of the Trip
— A material increase in the Trip Cost
Where a Significant Change occurs, Jetlagd will notify the Traveller and offer the choice of: (a) accepting the change; (b) transferring to an alternative Trip of equivalent or greater value; or (c) cancelling the Booking and receiving a full refund of monies paid. Jetlagd's liability in the event of a Significant Change is limited to the options described in this paragraph.
Changes made during a Trip for safety, operational, or local condition reasons do not constitute Significant Changes and shall not give rise to any right of cancellation or refund.
9. ACCOMMODATION
Accommodation on Jetlagd Trips varies by Trip and is specified on the trip page. Accommodation may range from luxury hotels, boutique properties, and standard hotels to hostels, glamping, and camping, depending on the nature and destination of the Trip.
Jetlagd reserves the right to substitute confirmed accommodation with accommodation of a comparable standard without prior notice, for any reason including but not limited to overbooking, property closure, safety concerns, or operational requirements. Where accommodation of a comparable standard is not available, Jetlagd will use reasonable endeavours to source accommodation of a higher standard at no additional cost to the Traveller.
Room allocation and configuration (single, twin, double, shared dormitory) are as specified in the Booking. Requests for specific room types or configurations are subject to availability and cannot be guaranteed. Single supplements are available on most Trips at the rates specified on the trip page.
Jetlagd is not responsible for the acts or omissions of accommodation providers and shall not be liable for any loss, damage, illness, or inconvenience arising from the standard or condition of accommodation provided by third-party Suppliers.
10. TRAVEL INSURANCE
Comprehensive travel insurance is a mandatory condition of participation in all Jetlagd Trips. By completing a Booking, the Lead Traveller confirms that all Travellers in the Booking will hold a valid travel insurance policy covering the full duration of the Trip before the final balance is due.
As a minimum, each Traveller's travel insurance policy must cover:
— Medical expenses and hospitalisation abroad
— Emergency medical evacuation and repatriation
— Trip cancellation and curtailment
— Loss or theft of baggage and personal belongings
— Personal liability
— Any adventure activities included in the Trip Itinerary
Jetlagd may request proof of insurance prior to departure. If a Traveller cannot produce evidence of adequate travel insurance, Jetlagd reserves the right to deny participation in the Trip without refund.
Jetlagd does not act as an insurance broker or agent and does not recommend specific insurance providers. Any information about insurance providers mentioned on our website or in our communications is provided for convenience only and does not constitute an endorsement or recommendation.
11. HEALTH, FITNESS, AND SPECIAL REQUIREMENTS
Each Trip carries a physical rating on the trip page. It is the Traveller's responsibility to read and assess the physical rating of their Trip before booking and to ensure they are in a suitable state of health and fitness to participate.
Travellers with pre-existing medical conditions, disabilities, or reduced mobility must disclose these to Jetlagd at the time of Booking. Jetlagd will use reasonable endeavours to accommodate special requirements but cannot guarantee that all requirements can be met in every destination. Failure to disclose relevant health information may result in a Traveller being excluded from certain activities or, in serious cases, from the Trip, without refund.
Jetlagd reserves the right to decline a Booking from, or exclude from a Trip, any Traveller whose medical or physical condition, in Jetlagd's reasonable opinion, poses a risk to the health or safety of that Traveller, other Travellers, or Jetlagd staff.
Dietary requirements must be disclosed at the time of Booking. While Jetlagd will use reasonable efforts to communicate dietary requirements to Suppliers, we cannot guarantee that dietary needs will be accommodated in all circumstances, particularly in remote destinations. Travellers with severe allergies are strongly advised to carry appropriate medication and to exercise personal vigilance.
12. LIMITATION OF LIABILITY
Nothing in these Terms shall exclude or limit Jetlagd's liability for death or personal injury caused by Jetlagd's proven gross negligence or wilful misconduct, or for any other liability that cannot be excluded under applicable Indian law.
Subject to the above:
Supplier Services
Jetlagd acts as an organiser and coordinator of travel services provided by independent third-party Suppliers, including accommodation providers, ground transport operators, local guides, activity providers, and other service partners. Jetlagd does not own or operate these Supplier services and shall not be liable for any act, omission, default, negligence, or breach of contract by any Supplier.
Cap on Liability
To the maximum extent permitted by applicable law, Jetlagd's total aggregate liability to a Traveller in connection with a Trip — whether in contract, tort (including negligence), or otherwise — shall not exceed the Trip Cost paid by that Traveller to Jetlagd in respect of that Trip.
Exclusion of Consequential Loss
Jetlagd shall not be liable for any indirect, consequential, incidental, or special loss or damage, including but not limited to loss of enjoyment, loss of earnings, loss of opportunity, costs of alternative arrangements, or any loss arising from flight delays, cancellations, or changes not caused by Jetlagd.
Website and Information
While Jetlagd uses reasonable care in preparing content on jetlagd.com, we do not warrant the accuracy, completeness, or currency of any information on our website, including trip descriptions, itinerary details, visa guidance, or pricing. Jetlagd shall not be liable for any loss arising from reliance on website content.
Independent Activities
Jetlagd shall not be liable for any loss, injury, or damage suffered by a Traveller in connection with any activity, excursion, or experience arranged independently by the Traveller outside the Trip Itinerary.
13. TRAVELLER CONDUCT AND CODE OF BEHAVIOUR
Jetlagd trips bring together people who share a genuine interest in travel. We expect all Travellers to contribute to an environment that is safe, respectful, and enjoyable for everyone.
All Travellers are required to:
— Treat fellow Travellers, Jetlagd staff, local guides, and members of the communities visited with respect and dignity at all times
— Comply with all local laws, regulations, and customs of the destinations visited
— Follow reasonable instructions from Jetlagd staff and local guides, particularly in relation to safety
— Refrain from behaviour that is abusive, threatening, discriminatory, or otherwise harmful to any person
— Refrain from the use of illegal substances during the Trip
— Avoid conduct that causes damage to property or reputational harm to Jetlagd
Jetlagd's local guides and trip leaders have full authority to address conduct that falls below these standards. In the event of a serious breach of this Code, or where a Traveller's behaviour poses a risk to the safety or wellbeing of any person, Jetlagd reserves the right to remove the Traveller from the Trip at any point, without refund of any portion of the Trip Cost. Jetlagd shall not be liable for any costs incurred by a removed Traveller, including accommodation, transport, or repatriation.
Where a Traveller is removed from a Trip due to conduct, Jetlagd may, at its discretion, bar that Traveller from making future bookings.
14. FORCE MAJEURE
A Force Majeure Event means any event or circumstance beyond Jetlagd's reasonable control that prevents or materially impairs the delivery of a Trip, including but not limited to:
— Acts of God, including natural disasters, earthquakes, floods, storms, volcanic eruptions, and epidemics or pandemics
— Acts of war, terrorism, civil unrest, riots, or political instability
— Government actions, travel advisories, border closures, or regulatory restrictions
— Industrial disputes, strikes, or labour actions affecting Suppliers
— Infrastructure failures, including power outages, transport network failures, or telecommunications disruptions
— Any other event that a reasonable person would consider outside Jetlagd's control
In the event of a Force Majeure Event that prevents or significantly affects the delivery of a Trip:
— Jetlagd may cancel, suspend, modify, or curtail the Trip without liability to the Traveller
— Jetlagd will use reasonable endeavours to provide alternative arrangements where practicable
— Where a Trip is cancelled prior to departure due to a Force Majeure Event, Jetlagd will offer the Traveller a credit voucher equal to the Trip Cost paid, valid for 12 months from the date of issue, or a refund of the Trip Cost less any non-recoverable costs already incurred by Jetlagd in connection with the Trip
— Where a Force Majeure Event occurs during a Trip, Jetlagd's liability is limited to using reasonable endeavours to assist affected Travellers and shall not extend to refund of any portion of the Trip Cost
Travellers are strongly advised to purchase travel insurance covering Force Majeure Events and trip curtailment.
15. COMPLAINTS AND DISPUTE RESOLUTION
If you experience a problem during your Trip, you must report it immediately to your local guide or trip leader so that Jetlagd has the opportunity to resolve it on the ground. Failure to report a problem during the Trip may affect your right to make a complaint after the Trip.
If your complaint is not resolved during the Trip, you must submit a written complaint to contact@jetlagd.com within 30 days of your return. We will acknowledge your complaint within 5 business days and aim to provide a substantive response within 28 days.
These Terms and any dispute or claim arising from them shall be governed by and construed in accordance with the laws of India. The courts of Pune, Maharashtra shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or any Booking.
16. JETLAGD CLUB AND JETPOINTS
The Jetlagd Club is Jetlagd's membership programme. Membership is subject to separate Club Terms which are incorporated into these Terms by reference and are available at jetlagd.com/club.
JetPoints are a rewards currency issued by Jetlagged Private Limited. JetPoints:
— Have no cash value except where expressly redeemed through the JetPoints redemption mechanism
— Are non-transferable and may not be sold, gifted, or assigned to another person
— Expire 12 months from the date of issue if not redeemed
— May be redeemed as travel credit against future Jetlagd Trip bookings at the rate published on the Club page, or converted to cash at a lower redemption rate as specified
— Cannot be applied retrospectively to confirmed Bookings
Jetlagd reserves the right to modify, suspend, or terminate the JetPoints programme at any time with 7 days' notice. In the event of termination of the JetPoints programme, Jetlagd will provide Travellers with a reasonable period in which to redeem outstanding JetPoints before they are cancelled.
Jetlagd reserves the right to cancel JetPoints that it reasonably believes have been earned or redeemed fraudulently or in breach of these Terms, and to terminate the Club membership of any Traveller engaged in such conduct.
17. INTELLECTUAL PROPERTY
All content on jetlagd.com, including text, photographs, videos, graphics, logos, and brand assets, is owned by or licensed to Jetlagged Private Limited and is protected by applicable Indian and international intellectual property laws. You may not reproduce, distribute, modify, or use any content from our website without our prior written consent.
User-Generated Content
By tagging Jetlagd or using Jetlagd-branded hashtags in content you post on social media in connection with a Trip, you grant Jetlagged Private Limited a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, display, and share that content across Jetlagd's marketing channels, including social media, website, and promotional materials, with attribution to you where reasonably practicable. If you do not wish your content to be used in this way, please notify us at contact@jetlagd.com.
18. PRIVACY AND DATA PROTECTION
Jetlagd collects and processes personal data in accordance with our Privacy Policy, available at jetlagd.com/privacy. By making a Booking or creating a Jetlagd Club account, you acknowledge that you have read our Privacy Policy and consent to the processing of your personal data as described therein.
The Lead Traveller is responsible for ensuring that all Additional Travellers in their Booking have been made aware of and have consented to the processing of their personal data by Jetlagd as described in the Privacy Policy.
19. WEBSITE USE
jetlagd.com is provided for the purpose of browsing, booking, and managing Jetlagd trips and membership. You agree not to:
— Use the website for any unlawful purpose or in a manner that infringes the rights of others
— Attempt to gain unauthorised access to any part of the website or its underlying systems
— Introduce viruses, malware, or other harmful code to the website
— Use automated tools to scrape, harvest, or extract data from the website without Jetlagd's prior written consent
Jetlagd reserves the right to suspend or terminate access to the website for any user who breaches these conditions, at its sole discretion and without notice.
Jetlagd does not warrant that the website will be available at all times or free from errors or interruptions. We shall not be liable for any loss arising from unavailability of or errors on the website.
20. GENERAL PROVISIONS
Entire Agreement
These Terms, together with the Booking confirmation, the Privacy Policy, and any other documents expressly incorporated by reference, constitute the entire agreement between Jetlagd and the Traveller in relation to the subject matter hereof and supersede all prior representations, agreements, and understandings.
Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.
Waiver
Jetlagd's failure to enforce any provision of these Terms on any occasion shall not constitute a waiver of that provision or of Jetlagd's right to enforce it on any future occasion.
Amendment
Jetlagd reserves the right to amend these Terms at any time. The version of these Terms in force at the time of your Booking shall apply to that Booking. Any amendments made after the date of your Booking confirmation shall not affect your existing Booking unless required by law.
Notices
All notices from Travellers to Jetlagd must be sent in writing to contact@jetlagd.com or to our registered address. Notices from Jetlagd to Travellers will be sent to the email address provided at the time of Booking.
Assignment
Jetlagd may assign or transfer its rights and obligations under these Terms to any successor entity or in connection with any restructuring, merger, or acquisition, without notice to the Traveller. The Traveller may not assign or transfer their rights or obligations under these Terms without Jetlagd's prior written consent.
Governing Law
These Terms are governed by the laws of India. The courts of Pune, Maharashtra, India shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms or any Booking.
